General conditions - motorbike rental

These general conditions are an integral part of the rental agreement concluded by the customer (hereinafter: the tenant) and Via Design doo Vrhpolje pri Kamnik 170, 1241 Kamnik (hereinafter: Via Design). The customer can conclude the rental agreement directly or through an agent.

Tenant

The renter is the signatory to the rental agreement and the person responsible for the motorcycle, regardless of who booked the motorcycle and/or paid the rental amount. The rented motorbike can only be operated by the renter, i.e. the person whose personal data is listed on the rental contract. The lessee undertakes to have a valid driver's license for the duration of the rental.

Landlord

The motorcycle is owned and leased by Via Design.

Car rental

The shortest rental is 1 day on working days (from Monday to Friday) or 2 days per weekend (Saturday and Sunday), with pickup of the motorcycle on Friday afternoon and return of the motorcycle on Monday morning, unless it is a holiday.

Required documents

The renter undertakes to have valid documents required for renting a motorcycle during the rental period: a valid passport or identity card and a valid driver's license. By submitting the reservation form, the renter declares that he is the owner of a valid driver's license for the rental period and for the motorcycle model he reserved.

Pickup and return of the engine

The renter receives the motorcycle in perfect condition, with all the necessary equipment and documents. The lessee undertakes to return the rented motorbike on the day of expiry of the rental agreement at the time and place specified in the rental agreement, and in the same condition as the motorbike was rented, with all equipment and documents.

If the renter has pre-booked the motor and there is a delay in taking over the motor or returns the motor before the end of the rental contract, the renter is not entitled to any monetary refunds and will pay the price for the entire rental period that was originally agreed upon.

If the tenant exceeds the agreed rental time, the first 59 minutes will not be charged. After exceeding this time, each additional hour is billed at the rate of 1/5 of the daily rental up to 5 hours, which amounts to the full price of the daily rental.

In the event that the renter collects the vehicle outside Via Design working hours (Monday - Friday from 8 a.m. to 4 p.m.), he pays an amount of EUR 30 for collection and return outside working hours.

The renter returns the engine with a full tank of fuel. Otherwise, the tenant will bear the cost of fuel and the cost of filling the tank according to the valid price list (€25 fuel price/liter). During the rental of the engine, the renter bears all the costs of the fuel and oil used.


The tenant may not:

• use the motorcycle for gainful activity,

• use the motorcycle to participate in motorcycle, speed or other competitions and tests,

• drive the motorcycle off-road or on a race track,

• sublease the motorcycle or sell the motorcycle, its parts, equipment and accessories to third parties,

• drive under the influence of alcohol, drugs or other substances that affect the ability to drive,

• overload the engine,

• technically or optically modify the engine,

• use the engine for illegal purposes.


Obligations of the lessee

The lessee undertakes to:

• maintain the water in the cooling system and the battery at appropriate levels.

• regularly check and maintain the oil level in the engine.

• maintain adequate air pressure in the tubes.


The renter will take all necessary care in handling and parking the motorcycle and will ensure that the motorcycle is securely locked when not in use. The renter will comply with all traffic rules and is responsible for all fines received during the rental period. Via Design will charge EUR 30 administrative costs for all unpaid fines.


Insurance

All engines are insured for damage against third parties and comprehensive insurance. A deposit of EUR 600 for the Honda CB650RA and EUR 1000 for the BMW R 1250 GS must be paid upon rental. The deposit is secured by payment in cash when the engine is taken over. The deposit is fully refunded if the renter returns the motorcycle undamaged. Any damage to the engine, up to the amount of the deposit paid, will be deducted from the deposit.

Engine failure

In the event of engine failure, the lessee undertakes to notify Via Design immediately and to follow all instructions provided by Via Design. All necessary repairs on the road can only be carried out by an authorized person. The original service invoice must be presented for possible replacement of parts or repair, otherwise Via Design will not accept reimbursement costs.


Accidents and theft

In the event of an accident or theft, the tenant undertakes to immediately notify the police and Via Design and follow their instructions. The lessee will secure all evidence (e.g. witnesses, tracks on the road, etc.) and record the personal information of everyone involved.

Engine damage

The renter is responsible for all damage to the rented motorbike, documents, parts and equipment of the motorbike that occurs during the rental period. This includes, but is not limited to: theft or loss, accident damage, damage as a result of improper use, damage that reduces the value of the engine. The term "damage" excludes normal wear and tear. Minor scratches from sand, pebbles and insects are considered normal wear and tear. Damage caused by an accident, dropping the motorcycle or driving the motorcycle through bushes or off-road is not considered normal wear and tear. The renter must immediately notify Via Design of any damage caused to the motorcycle and must follow Via Design's instructions regarding further action. In the event of damage to the rented engine, the hirer is responsible for repair costs, transport costs, expert costs, and any reduction in the technical and market value of the engine. In the event that Via Design has to transport the motorcycle back to the company headquarters due to damage for which the renter is responsible, Via Design reserves the right to charge the renter the cost of picking up the motorcycle in the amount of EUR 1 per kilometer driven.

Responsibility

The renter and all drivers bear the entire risk and responsibility for the risks and dangers that the rental of the motor vehicle may present. The renter understands that the owner, contractor and agent, including Via Design, are not responsible for the renter's safety and cannot in any way be responsible for any bodily or other injuries that occurred in connection with the rental of the vehicle. Via Design is not responsible for the loss or damage of personal items that the renter leaves on the motorcycle or in the suitcases during the rental period or after its expiration. The renter is responsible and assumes all obligations arising from non-observance of traffic regulations, improper parking or other violations of laws when using the vehicle and for all resulting damage from this title. This lessee's responsibility continues even after the termination of the rental agreement, if penalties or damages originate from the time when the lessee used the vehicle.

Final Provisions

All possible disputes arising from or in connection with these general conditions will be resolved by the competent court in Ljubljana, Slovenia.
